Elizabeth assisted in obtaining a dismissal in the District of Kansas for a Texas staffing company.  Beneficiaries of a life insurance policy sued the decedent’s former employer and its president, claiming that they failed to pay benefits and breached their fiduciary duty in violation of the Employee Retirement Income Security Act (ERISA).  The district court applied the forum selection clause in an employment agreement and dismissed the case for improper venue.  On appeal, the Tenth Circuit Court of Appeals affirmed the dismissal.
